Deceased Estate Application and Transfers
When a property owner has passed away their property becomes an asset of their estate. If in the circumstance the deceased was registered jointly with another person, they leave the surviving registered proprietor, to whom the share is automatically assumed. There is, however, a process that requires the appropriate land registration application to be lodged to enable this to effect.
Alternatively, where the deceased may have been registered solely or with separate shares with another party, the deceased estate is then transferred to the executor as appointed in a will (should one have been in existence) or to whom is appointed by grant of probate or letters of administration issued by the Supreme Court. An application by legal personal representative in this case will require to be lodged.
Here's where we come in, to ease the burden, whether that be in finalisation of the estate or in preparation to sell. You can be assured the team at Astute Conveyancing will manage either application process with care and compassion.
